Practical and Personal Advocates

We understand that clients in need of a family or probate attorney are often going through difficult times. We get to know our clients so we can understand their unique needs and zealously advocate for their rights.

Probate Administration

Probate is the legal process of settling an estate which may be necessary if court authority is required to access and distribute assets owned by the deceased. Probate typically involves preparing and filing certain documents with the Probate Court and helping the executor or administrator of the estate to take all steps required by the will and/or the law.  The legal and filing fees, as well as other costs, are typically paid from the estate property.

Probate Litigation

Disputes often arise concerning wills and probate administration.   Disappointed heirs or creditors of the estate may challenge the validity of a will or file a claim against the estate.   Similarly, an executor or administrator may need to file claims to recover or sell estate assets.   Allegations may also be made against the executor or administrator or against a trustee of estate assets for breach of fiduciary duty or negligence or other wrongdoing.

We represent executors, administrators, trustees, heirs, beneficiaries, and other individuals and entities in will contests, breach of fiduciary duties, accountings, and petitions for partition of real property.

Estate Planning

You work your whole life to build assets that have economic and emotional value.   If you want to determine how your assets will be divided and distributed then you must create an estate plan.   Such a plan should include a will and may include other legal documents such as a family trust or an insurance trust.   We will work with you to determine your specific needs and will prepare the appropriate documents.

In addition to estate planning, we can help you to ensure that your rights and wishes are respected if you have serious health issues or become incapacitated.   We can prepare a health care proxy, a living will, a health care directive, and a power-of-attorney to safeguard your rights and wishes.
